Art. 44 al. 1, art. 89 al. 1 LAMal: Compétence du tribunal arbitral selon l'art. 89 LAMal. La question de savoir si un hôpital peut facturer le séjour dans un service de soins intensifs d'après le tarif pour patients privés se rapporte à la protection tarifaire selon l'art. 44 al. 1 LAMal, de sorte que le tribunal arbitral est compétent pour y répondre. (consid. 2.5.1 - 2.5.4)

Art. 44 cpv. 1, art. 89 cpv. 1 LAMal: Competenza del tribunale arbitrale giusta l'art. 89 LAMal. La questione di sapere se un ospedale può fatturare la degenza presso un reparto di cure intense secondo la tariffa per pazienti privati riguarda la protezione tariffaria secondo l'art. 44 cpv. 1 LAMal, sicché il tribunale arbitrale è competente a statuire.
